Welcome to ClassNexus! These Terms of Service (“Terms”) govern your access to and use of the ClassNexus platform, a cloud-based Academy and School Management System (Software as a Service – SaaS). By registering an account, accessing, or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account and using ClassNexus, you (the “User”, “Academy Owner”, or “Subscriber”) agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.

2. Description of Service

ClassNexus provides cloud-based educational management tools, including but not limited to student enrollment, attendance tracking, fee management, examination records, and staff management. The platform is offered on a subscription basis.

3. User Accounts and Responsibilities

• Account Registration: You must provide accurate and complete information when creating an account.
• Security: You are responsible for maintaining the confidentiality of your account credentials (passwords). ClassNexus will not be liable for any loss or damage arising from your failure to protect your login information.
• Roles & Permissions: Academy Owners are responsible for the actions of any Staff, Teachers, Parents, or Students to whom they grant access via sub-accounts.

4. Free Trial and Subscriptions

• Free Trial: We may offer a limited-time free trial. Upon expiration of the free trial, your access will be restricted unless a paid subscription is purchased.
• Billing & Payments: All subscription fees must be paid in advance. Fees are non-refundable unless otherwise stated.
• Upgrades/Downgrades: You may upgrade your plan at any time. Changes to your billing will be applied in the current or next billing cycle.

5. Data Privacy and Ownership

• Your Data: You retain full ownership of all data (student records, financial data, etc.) you input into ClassNexus.
• Data Protection: We implement industry-standard security measures to protect your data. However, you acknowledge that no internet transmission is 100% secure.
• Privacy Policy: Our use of your data is governed by our Privacy Policy. We do not sell your academy’s data to third parties.

6. Acceptable Use Policy

You agree NOT to use ClassNexus to:

• Violate any local, national, or international laws.
• Upload or transmit viruses, malware, or destructive code.
• Attempt to hack, disrupt, or bypass the security mechanisms of the platform.
• Send spam or unsolicited messages through our integrated SMS/Email systems.

7. Service Availability & Maintenance

• Uptime: We strive for 99.9% uptime. However, services may occasionally be interrupted for scheduled maintenance, upgrades, or emergency repairs.
• Modifications: We reserve the right to modify or discontinue features of the service with or without prior notice.

8. Termination and Cancellation

• By User: You may cancel your subscription at any time. Your data will remain accessible until the end of your current billing cycle.
• By ClassNexus: We reserve the right to suspend or terminate your account immediately if you violate these Terms, fail to pay subscription fees, or engage in fraudulent activities.

9. Limitation of Liability

To the maximum extent permitted by law, ClassNexus and its developers shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business interruptions arising out of the use or inability to use the platform.

10. Changes to Terms

We reserve the right to update these Terms at any time. We will notify active users of significant changes via email or dashboard notifications. Continued use of the platform after updates constitutes acceptance of the new Terms.
